1. Beta Testing Agreement

Applies to all users during the beta period

Beta software notice

Project Helix is currently in beta. The software is provided for evaluation and testing purposes. Features may change, be removed, or behave unexpectedly. You acknowledge that beta software may contain bugs or errors that could affect its operation.

1.1 Purpose. By installing or using Project Helix during the beta period, you agree to evaluate the software and, where possible, provide feedback to Candocgo Corp. (sales@projecthelix.ca).

1.2 No warranty during beta. The beta version of Project Helix is provided "as is" without any warranty of fitness for a particular purpose. Candocgo Corp. makes no representation that the software will be free of errors or that any generated traffic control plan will satisfy all applicable regulatory, municipal, or road authority requirements in any specific field situation.

1.3 Professional responsibility. Project Helix generates traffic control plan layouts based on OTM Book 7 rules as implemented in the on-device engine. All generated plans must be reviewed and approved by a qualified traffic control supervisor or engineer before implementation in the field. The app does not replace professional judgment. Candocgo Corp. is not liable for any incident, injury, property damage, or regulatory non-compliance arising from reliance on app-generated plans without independent professional review.

1.4 Feedback. Any feedback, bug reports, or suggestions you provide during the beta period may be used by Candocgo Corp. to improve the software without compensation or attribution to you.

1.5 Beta period and pricing. The beta trial period is 30 days at no charge. After the trial period, continued access requires a paid subscription at the then-current rate (currently $50.00 CAD/month). Candocgo Corp. reserves the right to modify pricing, features, or availability at any time during or after the beta period with reasonable notice.

1.6 Confidentiality. During the beta period, you agree not to publicly disclose specific details of unreleased features, engine behavior, or internal compliance logic without written permission from Candocgo Corp.


2. Terms of Service

Governs your use of Project Helix software and services

2.1 Agreement. By downloading, installing, or using Project Helix ("the App"), you ("User") agree to be bound by these Terms of Service with Candocgo Corp. ("Company," "we," "us"), a federally incorporated Canadian corporation. If you do not agree, do not install or use the App.

2.2 Licence. Subject to these Terms, Candocgo Corp. grants you a limited, non-exclusive, non-transferable, revocable licence to install and use Project Helix on Android devices you own or control, solely for your internal business or professional purposes in Ontario, Canada.

2.3 Permitted use. The App is intended for use by qualified construction and traffic control professionals operating in Ontario under OTM Book 7 standards. You represent that you have the professional qualifications required to evaluate and implement any traffic control plan generated by the App.

2.4 Prohibited use. You may not: (a) reverse engineer, decompile, or disassemble the App; (b) redistribute or resell the App or generated plans as a standalone product; (c) use the App for any unlawful purpose; (d) attempt to circumvent any access control or subscription mechanism; (e) use the App outside of Ontario without written agreement from Candocgo Corp.

2.5 Subscription and billing. Subscriptions are billed monthly through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial months. Candocgo Corp. reserves the right to suspend access for non-payment.

2.6 Disclaimer of warranties. The App is provided "as is." To the maximum extent permitted by applicable Canadian law, Candocgo Corp. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

2.7 Limitation of liability. To the maximum extent permitted by law, Candocgo Corp. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including damages arising from construction site incidents, regulatory non-compliance, or reliance on generated traffic control plans. Our total aggregate liability shall not exceed the amount you paid us in the three months preceding the claim.

2.8 Governing law. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

2.9 Changes to Terms. Candocgo Corp. may update these Terms at any time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the App after that date constitutes acceptance.

2.10 Termination. We may suspend or terminate your access for breach of these Terms, non-payment, or misuse of the App, with or without notice depending on severity.


3. Privacy Policy

How we collect, use, and protect your data

Canadian data residency

All Project Helix data is processed and stored on servers located in Canada (OVH dedicated infrastructure, Quebec). No jobsite data is sent to servers outside Canada.

3.1 What we collect.

  • Account data: Email address collected via Stripe at subscription signup. We do not store payment card details — these are handled exclusively by Stripe.
  • Jobsite location data: When you create a traffic control plan, the App sends your jobsite perimeter coordinates (latitude/longitude polygon) and road segment identifiers to our Canadian data host to retrieve Ontario Road Network (ORN) road data, LiDAR elevation profiles, and sight distance checks. This data is used solely to generate your traffic control plan and is not retained beyond the duration of your session.
  • App version data: On launch, the App sends your current app version and platform (Android) to our version service to check for critical updates. No personal identifiers are included in this request.
  • Crash and diagnostic data: Debug trace logs may be generated locally on your device during plan generation. These are not automatically transmitted to us; you would need to share them manually when reporting issues.

3.2 What we do not collect. We do not collect: names, phone numbers, physical addresses, device identifiers, advertising IDs, or location data beyond jobsite coordinates you explicitly enter in the App. We do not sell, rent, or share your data with third parties for marketing purposes.

3.3 Third-party services.

  • Stripe: Processes subscription payments. Subject to Stripe's own privacy policy (stripe.com/privacy).
  • Google Maps: The Android app uses the Google Maps SDK for map rendering. Map tile requests are subject to Google's privacy policy. Your jobsite coordinates are sent to Google only as map tile requests (viewport bounds), not as identified jobsite data.
  • Nominatim / OpenStreetMap: Address search in the App uses the public Nominatim geocoding service. Search queries may be logged by Nominatim per their usage policy.

3.4 Data retention. Jobsite coordinates sent to our data host are not persisted beyond your active session. Account email is retained while your subscription is active and for up to 90 days after cancellation for billing records. You may request deletion by emailing sales@projecthelix.ca.

3.5 Your rights (PIPEDA). Under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), you have the right to access, correct, or request deletion of personal information we hold about you. To exercise these rights, contact us at sales@projecthelix.ca.

3.6 Security. All data transmitted between the App and our servers uses TLS encryption (HTTPS). Our data host infrastructure is protected by fail2ban intrusion detection and restricted SSH access.

3.7 Children. Project Helix is not directed at individuals under 18. We do not knowingly collect data from minors.
